This Privacy Policy (the "Privacy Policy") and other policies which may be posted on this Web Site (the "Site"), such as terms and conditions of use and, if you register for or enroll in any of the services, contests, products or materials (including to make a posting or submission, a donation or a purchase or to subscribe to a publication), provided by American Bible Society, americanbible.org, bibles.com, bibles.org or any of our affiliates on this Site ("American Bible Society" or "ABS"), those registration or enrollment terms (the "Other Agreements"), together govern your use of this Site. ALL OF THE AFORE-MENTIONED GOVERN YOUR USE OF THE SITE EVEN IN THE EVENT YOU ARE ACTING AS AN EMPLOYEE, AGENT, REPRESENTATIVE OR CONTRACTOR ON BEHALF OF ANY OTHER ENTITY OR PERSON. This Privacy Policy explains how we collect your Personal Data (as defined below) on the Site, how we protect such data, and the choices you have concerning our use of such data. Please read this Privacy Policy carefully. This Privacy Policy represents our current (as of the date first written above) data collection and usage practices. ABS will from time to time review and revise these practices. We will post any changes to this Privacy Policy here. Please refer back to this Privacy Policy on a regular basis. For the purposes of this Privacy Policy, "ABS", "we", "us", and "our" means ABS and its affiliates.

Our policy regulating this Site is simple:

The American Bible Society is committed to protecting your privacy. We allow you to provide as much personal information as you feel comfortable providing. We do not release personal information about you to any third party, except as expressly permitted by you or required by law or court order. We take all reasonable steps to protect your privacy, regardless of how much information you provide.

You control what personal information you provide to us online, and what we can do with such information. You may provide us information about yourself to help us make our Web sites more responsive to you.

We may ask you to supply personal information to us online, including your e-mail address, during a "registration" or an "enrollment" process. Some of this information is given voluntarily, and the word "optional" appears next to the relevant questions. On occasion, we collect additional personal information in optional survey forms, order forms, donation forms and contest registration forms. Demographic information voluntarily provided by you may be combined with site usage reports to create a profile of users and their preferences.

This Privacy Policy applies only to information collected by the Site. We are not responsible for the privacy of any information (i) that you reveal or post in any public forum that may be or in the future become available on the Site (e.g., message board or chat room), (ii) that is available now to the general public through no action or fault of ABS, or (iii) that ABS receives from any third party reasonably known to have a legal right to transmit such information and under no obligation to keep such information confidential. We are also not responsible for the privacy practices of Web Sites that are operated or owned by third parties.

Collection of Personal Data

Personal data is information that identifies you or can be used to identify or contact you, e.g. your name, e-mail address, postal address, or phone number ("Personal Data"). ABS requests Personal Data from you when you register or enroll for use of the Site. The registration or enrollment process requests that you provide your name and e-mail address, and agree to the terms and conditions and, should there be any, the Other Agreements, presented at the time of registration or enrollment. ABS requests additional Personal Data from you when you agree to make a donation or a purchase. Depending on the process, you may be requested that you provide your name, e-mail address, postal address, phone number, credit or bank card or other form of payment, and agree to the terms and conditions and, should there be any, the Other Agreements, presented at the time of donation or purchase. In addition to information collected during registration or enrollment, or when making a donation or a purchase, ABS may collect Personal Data knowingly provided by you in e-mails to the Site or, among other things, online forms, order and registration forms and surveys. Providing this information is always at your option.

In all of these cases, we will collect Personal Data from you only if you voluntarily submit such information to us, and we will only contact you if you permit us to do so. Unless you give us permission to do so, we will not sell, share, license, trade or rent your Personal Data other than as specified in this Privacy Policy. We may, from time to time include on the Site or in e-mails, alerts or other mailings you have agreed to accept from us, advertisements or offers from or information about a sponsor or other third parties interested in serving you ("Third-Party Providers"). This does not and will not mean that ABS endorses any specific materials, information or services available from such Third-Party Providers. Such materials from those Third-Party Providers, regardless of their relationship with us, are provided merely for information purposes and users should make their own judgments and evaluation of any services or products available on any other web sites.

You do not have to provide us with any Personal Data to visit the Site. However, if you choose to withhold requested information, you may not be able to visit all sections or use all features of the Site.

Collection of Monitoring Data and Use of Tracking Tools

In addition to Personal Data, ABS may collect and/or track information that by itself is not used to identify you personally or to contact you, e.g., demographic information, domain names, computer type, browser types, screen resolution, and other anonymous statistical data involving the use of the Site ("Monitoring Data"). We use Monitoring Data to help us understand who uses the Site and to improve and market it and ABS’s other web sites.

ABS assigns a random number anonymously to each user for tracking content preferences and traffic patterns. This random number enables us to record how many times users access certain pages, without "naming" who those users are. This random number, called a "cookie," is kept in a file on your computer.

We also log Internet Protocol ("IP") addresses, or the location of your computer on the Internet, for systems administration. These IP addresses are not used to track your session nor are they linked to anything personally identifiable. Cookies and IP addresses ("Tracking Tools") by themselves cannot be used to determine the identity of any user.

To enhance the Internet experience on the Site, ABS may use various Internet technologies such as, without limitation, ‘cookies,’ ‘action tags,’ ‘web bug,’ ‘.gif tags,’ and ‘JavaScript’. We believe Tracking Tools and other Internet technologies add value to the user experience, and the information obtained through these technologies is not sold or otherwise made available to third parties by ABS, other than as may from time to time be specified in this Privacy Policy.

Use of Data Collected

We ask for some optional information so we can maintain a further dialogue with you about our new products and services. When you revisit the Site, ABS may recognize you by a Tracking Tool and customize your experience accordingly. For example, once you have completed the registration or enrollment process, a cookie will be used to avoid having you register again. You may decline Internet cookies, if any, by using the appropriate feature of your Web browser software, if available. If cookies are disabled, however, all features of the Site may not operate as intended. Information about the procedure you are required to follow in order to disable cookies can be found on your Internet browser provider’s Web Site.

ABS may use Personal Data and Monitoring Data it collects for editorial and feedback purposes, marketing and promotion, statistical analysis of users’ behavior, product development, delivering products and services, providing customer support, customizing and improving the content and layout of the Site or other web sites of ABS, completing business transactions, administering individual accounts and meeting government regulatory requirements. Monitoring Data may be used for internal or external purposes such as researching and identifying market segments and needs. ABS may disclose your Personal Data to unaffiliated third parties if we believe in good faith that such disclosure is necessary (a) to comply with applicable laws, rules, or regulations, or to preserve ABS’s legal rights in the Site’s content, whether the same arises from contract or through force of law; (b) to provide you with any services, information, special offers, promotions or products you requested or consented to and to allow us to perform other activities related to such services and products; or (c) to operate this Site and other of ABS’ systems properly. ABS may also share your Personal Data with a Third-Party Provider, but only if you have first told us we may. You may also share your Personal Data directly with Third-Party Providers who you contact through the Site.

You should be aware that, once you give such permission for ABS to share, or once you have shared, your Personal Data with a Third-Party Provider, ABS is not responsible for any further use or disclosure of your Personal Data by Third-Party Providers; such use or disclosure is governed by the Third-Party Providers' privacy policies.

In each e-mail we may send you, you will have the option to unsubscribe and not receive future e-mail from us. We cannot make such assurances on behalf of any Third-Party Provider. Please review our Opt-Out Policy (below) for how to avoid receiving further e-mails.

You may modify, correct, change or update Personal Data that ABS has collected via the Site or request that your Personal Data be removed from ABS’ database by contacting ABS pursuant to the Opt-Out Policy indicated above. If you have made donations to or purchases from or otherwise registered with us in the past, you may also request that your Personal Data be removed from ABS’ database by contacting ABS via e-mail at webmaster@americanbible.org. In any instance, our removal of such information may require you to register again with ABS in the event you later wish full access to the Site.

You should be aware that it may not be technologically possible to remove or verify each and every record of information you have provided to us from our system. The need to back-up our systems to protect information from inadvertent loss means that a copy of your Personal Data may exist in archived systems. However, after receiving your request, all Personal Data stored in databases we actively use and other readily searchable media will be updated, corrected, changed, deleted or confirmed to you, as appropriate, as soon as reasonably practicable.

ABS does not endorse, and is not responsible for, the privacy practices or the content of these Web Sites. Security Measures

ABS has established reasonable precautions to protect collected Personal Data from loss, misuse, unauthorized access, disclosure, alteration or destruction, which include contractual, administrative, physical, and technical steps. Technical measures include use of firewall protection and encryption technology where appropriate. Although ABS takes reasonable precautions to assess the reliability of such technology, it relies on the statements of the vendors of those products and services as part of its security evaluation. BY USING THE SITE, YOU ACKNOWLEDGE AND CONSENT TO THE FACT THAT ABS SHALL HAVE NO LIABILITY FOR FAILURES OF SUCH PRODUCTS AND SERVICES AND THAT YOU SHALL HAVE RECOURSE SOLELY AGAINST THE MANUFACTURERS OR VENDORS THEREOF. Please note that while ABS has endeavored to create a secure and reliable site for users, the confidentiality of any communication or material transmitted to/from ABS or the Site or via e-mail cannot be guaranteed.

Export of Personal Data

By using the Site, you acknowledge and consent to the fact that Personal Data provided by you or collected by us through your use of the Site is stored and processed by us in the United States where data protection laws may not afford the same level of protection as those of the country in which you are located (this is the case for users located in the European Economic Area ("EEA")). You also acknowledge and consent to the fact that we may, at our discretion, store and process such data in other countries (including countries outside the EEA) where data protection laws or law enforcement systems, policies or professionals may not afford the same level of protection as those of the country in which you are located.

Privacy Protections for Children Using the Internet

Protecting children's privacy is important to us. For that reason, we do not collect or maintain information on our Site from those we actually know are under the age of 13, nor is any part of our Site targeted to attract anyone under 13. We request that all visitors to our Site who are under 13 not disclose or provide any personally identifiable information. If we discover that a child under 13 has provided us with personally identifiable information, we will delete that child's personally identifiable information from our records.

These Terms and Conditions of Use ("Terms and Conditions") contain the terms, covenants, conditions, and provisions upon which you (also sometimes referred to herein as "User") may access and use this Site and the content, including (without limitation) the information displayed on the Site. These Terms and Conditions are current as of the date above and, together with any Special Terms and Other Agreements (defined below) and our Privacy Policy comprise your agreement with us.

By using any part of this Site, you acknowledge that you have read these Terms and Conditions, understand them, and agree to be bound by their terms and conditions.   4. Privacy Policy. Please see the ABS Privacy Policy for a summary of ABS personal data collection and use practices with respect to the Site. By using the Site, you consent to the collection and use of Personal Data by ABS as outlined therein, including the right to view, monitor, and record activity on the Site without notice or further permission from you, to the fullest extent permitted by applicable law. Any information obtained by monitoring, reviewing, or recording is subject to review by law enforcement organizations in connection with the investigation or prosecution of possible criminal activity on any of the Site. ABS will also comply with all court orders involving requests for such information.

If you choose to access the Site from any such location, you do so on your own volition and are responsible for compliance with any applicable local laws. You agree and acknowledge that no oral or written information or advice given by ABS or any of its employees or agents in respect to the Site shall constitute a representation or a warranty unless such information or advice is incorporated into these Terms and Conditions by a written agreement.

    UNDER NO CIRCUMSTANCES WILL ABS OR ITS LICENSORS OR SUPPLIERS BE LIABLE TO YOU—AS A RESULT OF YOUR USE OF THE SITE, ANY ITEMS, SERVICES OR MATERIALS DOWNLOADED FROM THE SITE (INCLUDING, WITHOUT LIMITATION, WIDGETS AND GADGETS), OR ANY RELATED MATERIALS, PRODUCTS, SERVICES OR INFORMATION—FOR ANY SPECIAL, INDIRECT, INCIDENTAL OR CONSEQUENTIAL DAMAGES OF ANY KIND, INCLUDING, BUT NOT LIMITED TO, COMPENSATION, REIMBURSEMENT OR DAMAGES ON ACCOUNT OF THE LOSS OF PRESENT OR PROSPECTIVE PROFITS, EXPENDITURES, INVESTMENTS OR COMMITMENTS, WHETHER MADE IN THE ESTABLISHMENT, DEVELOPMENT OR MAINTENANCE OF BUSINESS REPUTATION OR GOODWILL, FOR ANY LOSS OR OTHER IMPAIRMENT OF DATA OR SERVICE(S), COST OF SUBSTITUTE MATERIALS, PRODUCTS, SERVICES, KNOW-HOW OR INFORMATION, COST OF CAPITAL, AND THE CLAIMS OF ANY THIRD PARTY, OR FOR ANY OTHER REASON WHATSOEVER, EVEN IF ABS OR ITS LICENSORS OR SUPPLIERS HAVE BEEN ADVISED OF THE POSSIBILITY OF DAMAGES.

    IN ANY EVENT, THE AGGREGATE LIABILITY OF ABS AND ITS LICENSORS AND SUPPLIERS FOR ANY REASON WHATSOEVER RELATED TO USE OF THE SITE AND ITS CONTENT SHALL NOT EXCEED ONE HUNDRED UNITED STATES DOLLARS (US $100.00).
  10. Indemnity. You agree to indemnify and hold harmless ABS, its licensors and suppliers, all of their affiliates, and all of their respective officers, directors, employees, shareholders, legal representatives, agents, successors and assigns, from and against any damages, liabilities, costs and expenses (including reasonable attorneys' and professionals' fees and court costs) arising out of any third party claims based on or related to your use of the Site or any breach by you of these Terms and Conditions .
  11. Submissions. Any ideas, suggestions, information, postings, up-loaded material, know-how or any other content (collectively, "Submissions") however received for the Site from you will be deemed to include a royalty-free, perpetual, irrevocable, nonexclusive right and license for ABS, without limitation, to adopt, publish, reproduce, disseminate, transmit, distribute, copy, use, create updates, analyses or other derivative works, publicly display or broadcast (in whole or part), or act on such Submissions without additional approval or consideration, in any form, media, or technology now known or later developed for the full term of any rights that may exist in such Submissions. You acknowledge and agree that you will receive no compensation for any use by ABS of, or ideas or suggestions you provide in, your Submissions.  You also acknowledge and agree that ABS shall not be liable for any failure to store or display Submissions at any time.
  12. User-Generated Content; User Acknowledgements. From time-to-time and in addition to Submissions, certain features of the Site may permit you and other users to register on the Site using secure passwords in order to make submissions, transmissions, or postings (collectively "post"; such posts, together with Submissions, are "User-Generated Content").  You acknowledge and agree that: (a) The User-Generated Content you post will be accessible by ABS, you, and any other users who are entitled to similar privileges; that any message or information you send to this Site may be read or intercepted by others unless there is a special notice that a particular message (for example, credit card information) is encrypted (sent in code); that sending a message to ABS does not devolve any special responsibility on ABS to you; that ABS does not pre-screen User-Generated Content; and that by accessing or using the Site, you may be exposed to User-Generated Content posted by others that is offensive or otherwise objectionable; (b) You are solely responsible for all of the User-Generated Content that you post on the Site; you assume all risks associated with use of the User-Generated Content that you post, including any reliance on its accuracy, completeness or usefulness by others, or any disclosure by you of information in the User-Generated Content you post that makes you personally identifiable; and, by posting User-Generated Content, you represent and warrant that you own or otherwise control all of the intellectual property rights and other rights to that User-Generated Content, including all the rights necessary for you to post that User-Generated Content; (c) ABS may, but is not required to, display or use any of the User-Generated Content that you provide; may remove any posted User-Generated Content from the Site for any reason without notice in its sole discretion; and shall not be liable for any failure to store or display User-Generated Content on the Site at any time; (d) For all of the User-Generated Content that you post to ABS, you grant users of the Site a non-exclusive, non-transferable, limited license to display, edit, download, and print such User-Generated Content solely for their own noncommercial, professional use in connection with their use of the Site; and you also grant ABS a non-exclusive, non-transferable, limited license to use, reproduce, create updates, analyses or other derivative works, publicly display or broadcast (in whole or in part), publicly perform, copy, edit, modify, translate, reformat, transmit and distribute your User-Generated Content for any purpose without additional approval or consideration, in any form, media, or technology now known or later developed for the full term of any rights that may exist in such User-Generated Content.  You acknowledge and agree that you will receive no compensation for any use by ABS of, or ideas or suggestions you provide in, your User-Generated Content and you give up any claim that any use of such material violates any of your rights, including moral rights, privacy rights, proprietary or other property rights, publicity rights, rights to credit for material or ideas or any other right, including the right to approve the way ABS uses such material; and (e) If you believe that any User-Generated Content is infringing copyrights or other intellectual property rights held by you or by someone on whose behalf you are authorized to act, please follow the steps described here.
  13. Governing Law. These Terms and Conditions, including (without limitation) any disputes relating to the content the Site, whether sounding in contract, tort, statute or otherwise, are governed by the laws of the State of New York, without reference to its conflict of law principles and without regard to the U.N. Convention on Contracts for the International Sale of Goods.
  14. Dispute Resolution. Any litigation arising out of or connected in any way with these Terms shall take place in a State or Federal court of competent jurisdiction in New York, NY.  You hereby consent to personal jurisdiction and venue in the State and Federal courts located in the State of New York, New York County, with respect to any actions, claims, disputes or proceedings arising out of or in connection with these Terms. Any dispute, controversy or claim arising out of or relating to these Terms and Conditions, including any disputes relating to the content of the Site, whether sounding in contract, tort, statute or otherwise, shall be first subject to mediation and, if mediation is unsuccessful, finally resolved by legally binding arbitration in accordance with the Rules of Procedure for Christian Conciliation of Peacemakers Ministries, set forth at http://www.hispeace.org/html/geticrul.htm. The place of the arbitration shall be New York, NY. The decision of the arbitrators shall be binding upon the parties hereto, and the expense of the arbitration (including without limitation the award of attorneys’ fees to the prevailing party) shall be paid as the arbitrators determine. The decision of the arbitrator may be entered by any court of competent jurisdiction. You agree to submit to the jurisdiction of the state and federal courts in the State of New York for the purposes of any judicial proceedings to obtain interim relief and in aid of the arbitration or judicial proceedings to confirm or enforce the award. Notwithstanding the foregoing, ABS may seek preliminary injunctive relief from a court of law in the event of a breach by you.
  15. Term, Termination, Amendments. These Terms and Conditions will take effect when you first commence using the Site. ABS reserves the right at any time and for any reason to deny you access to the Site or any portion thereof. Termination will be effective without notice. Please note that ABS reserves the right to change the terms and conditions of these Terms and Conditions upon notice, which may be given by ABS’ posting such change on the Site, by e-mail, or any other reasonable method. If a change is implemented by a posting on the Site, it shall be deemed to take effect when posted; if a change is announced by e-mail, it shall be deemed to take effect when the e-mail is sent; and if a modification is announced in any other way, it shall be deemed to take effect when the relevant notice is sent or issued by or on behalf of ABS. Your continued use of the Site following notice of such modifications will be conclusively deemed acceptance of any changes to these Terms and Conditions. You agree that notice of changes to these Terms and Conditions on the Site, delivered by e-mail, or provided in any other reasonable way constitutes reasonable and sufficient notice.
  16. Waiver. Failure to insist on strict performance of any of the terms and conditions of these Terms and Conditions will not operate as a waiver of any subsequent default or failure of performance. No waiver by ABS of any right under these Terms and Conditions will be deemed to be either a waiver of any other right or provision or a waiver of that same right or provision at any other time.
  17. Nature of Relationship. No joint venture, partnership, employment, or agency relationship exists between you and ABS as a result of these Terms and Conditions or your utilization of the Site.
  18. Severability. If any provision of these Terms and Conditions is held unenforceable by a court or tribunal of competent jurisdiction, that provision shall be enforced to the maximum extent permissible so as to effect the intent of the parties, and the remainder of these Terms and Conditions shall continue in full force and effect.
  19. Entire Agreement/Reservation of Rights. Particular pages or features of the Site with content supplied by ABS or its licensors may have different or additional terms ("Special Terms"), which will be disclosed to you when you access those pages or features and which include copyright policies. By accessing or using such pages and features, you will be deemed to have agreed to the applicable Special Terms. If there is a conflict between these Terms and Conditions and the Special Terms, the Special Terms will govern with respect to such pages or features or content. If you register for or enroll in any of the services, contests, products or materials, including to make a donation, provided by American Bible Society, americanbible.org, bibles.com, bibles.org or any of our affiliates on this Site ("American Bible Society" or "ABS"), those registration or enrollment terms (the "Other Agreements") together govern your use of this Site. In the event of a conflict between these Terms and Conditions and one or more Other Agreements, the terms of such Other Agreement(s) shall govern and control. Along with any Special Terms and Other Agreements, these Terms and Use and ABS’s Privacy Policy represent the entire agreement between you and ABS with respect to your use of and material available on or through the Site, and it supersedes all prior or contemporaneous communications and proposals, whether electronic, oral, or written between you and ABS with respect to the Site. Any rights not expressly granted herein are reserved.
  20. Miscellaneous Provisions. (a) The provisions of Paragraphs 8, 9, 12, and 13 shall survive any termination or expiration of this Agreement. (b) The headings and captions contained in these Terms and Conditions are inserted for convenience only and shall not constitute a part hereof. License Agreement - Bible Search Facility API

This Application Programming Interface ("API") is designed to enable your software program to access Bible texts that are available through ABS's Bible Search facility ("Texts"). ABS is pleased to provide this API to you, under a one-year renewable license, in return for your agreement that you:

A. Will:

  1. Comply with the Terms and Conditions of Use of the ABS Bible Search web site.
  2. Fully honor the copyrights of all Texts and display the appropriate copyright notices and trademarks as set forth in the Versions Index. Copyright notices and information are included in every API response.
  3. Implement the Fair Use & Copyright Management System as documented here prior to using the API. The purpose of the Fair Use & Copyright Management System is explained in the introduction to the API
  4. Periodically clear cache (at least every 14 days) to ensure that you are working with the latest version of the Texts, and that any bug-fixes we've applied to the service are included in the content you receive.

B. Will Not:

  1. Make any modification to the Texts.
  2. Charge a fee for access to or use of the Texts.
  3. Impugn the reputation of any Text or the copyright owner of any Text.
  4. Use any Text in any material or communication that (a) advocates or encourages violence: (b) may reasonably be perceived as unlawful, defamatory, offensive, obscene, vulgar, pornographic, threatening, abusive, misleading, deceptive, or bigoted (racially, ethnically, or otherwise objectionable); (c) contains false or unauthentic text; or (d) contains inappropriately negative comments about the Bible or Jesus Christ, or any other religious sect, text or organization.
  5. Perform more than 5,000 queries a day without advance written permission from ABS, which may be requested by contacting support@bibles.org.
  6. Sell, share, or publish your access key.

If you agree to all these things, ABS will provide you with an access key to access the API and the Texts for one year. We will contact you before your key expires, at which time you may renew it. However, ABS reserves the right to deny access and revoke your key at any time, in its sole discretion, although we will make a good faith effort to provide reasonable advance notice if the reason is other than your failure to comply with this License Agreement. You may terminate this relationship at any time by contacting support@bibles.org. If access is revoked, all cached copies of Text must be removed from your servers and/or services within 14 days.

ABS's Bible Search facility and this API are provided to you free of charge, as is. While we make every effort to maintain and enhance this service consistent with the highest standards of excellence, we cannot guarantee that the API service will always be available, nor that the service will integrate with and not adversely impact your computer systems. By accepting this License you agree to accept all risks associated with your use of this API and the Bible Search facility, and to hold ABS harmless from any claims that otherwise might be made against ABS relating to this License and your use of the API and the Bible Search facility.
